Most people worry about buildings being under-designed. 

But what if the real problem is that they’re over-designed? 

It’s something we’re seeing more often, and it’s exactly why we’ve recently been asked to act as Expert Witnesses on a high-value residential project. 

The issue isn’t whether the building is safe. 

The question is whether it has been engineered efficiently. 

Safe doesn’t mean excessive 

Structural design codes already include reasonable margins of safety. They have been developed over decades through research, testing and real-world performance. 

As Chartered Structural Engineers, our job is to design within those codes. 

What we shouldn’t do is add our own extra “just to be safe” safety factors on top. 

Historically, some engineers have done exactly that. While it may feel cautious, it often results in structures that use far more material than they need.

The £250,000 question 

The project we’ve been asked to review involves a substantial private house of around 600–700m². 

During the design process, the foundation solution changed from piled foundations to a reinforced concrete raft foundation. 

There’s nothing unusual about changing foundation solutions. 

What is unusual is the amount of reinforcement specified. 

An initial assessment suggests that the additional concrete reinforcement alone could add around £250,000 to the construction cost. 

That’s before considering the knock-on effects of additional labour, programme time and embodied carbon. 

Our role as Expert Witnesses is to provide an independent opinion on whether that level of reinforcement is technically justified. 

Good engineering isn’t about designing everything for the worst case 

One of the biggest mistakes engineers can make is designing an entire structure for its most heavily loaded area. 

Imagine a floor slab. 

Perhaps one small section carries a particularly heavy load. The easiest solution is to specify the same heavy reinforcement throughout the whole slab. 

It makes the drawings simpler. 

It makes installation simpler. 

But it isn’t efficient engineering. 

A better approach is to understand where those higher loads occur and provide additional reinforcement only where it’s actually needed. 

The majority of the slab may require considerably less. 

That’s what thoughtful engineering looks like. 

Computers don’t replace engineering judgement 

Modern design software is incredibly powerful. 

But software only calculates what it’s been told. 

If the wrong loading is entered, or assumptions are incorrect, the software will still produce an answer. And sometimes that software can determine a problem that may not be real! 

Experience is what tells you when that answer doesn’t look right. 

There is extensive published guidance on reinforced concrete design, including typical reinforcement percentages for different situations. 

If a design comes out requiring significantly more reinforcement than expected, an experienced engineer should stop and ask: 

“Why?” 

Sometimes there’s a perfectly valid explanation. 

Sometimes there isn’t. 

That’s where engineering judgement becomes just as important as the software itself.

Designing to 100% Utilisation 

At Michael Aubrey Structural Engineers, we aim to design as close as practical to 100% utilisation. 

That doesn’t mean taking risks. 

It means making full use of the capacity that the design standards already allow. 

If the code says a member is adequate, there is no need to add another arbitrary margin of safety. 

But sometimes for construction it is still the best solution to use slightly more material but simplify design to minimise the risk of site errors, increase repetition and reduce overall cost.  More engineering judgement rather than ‘computer says yes or no’ engineering. 

Designing efficiently can reduces: 

  • Material costs
  • Construction costs
  • Embodied carbon
  • Programme time

while still delivering a safe, fully compliant structure. 

Efficient engineering is good engineering. 

Why does overdesign happen? 

There are several reasons. 

  • Sometimes engineers are placed under intense fee or ‘real-time’ 
  • Clients naturally compare engineering fees and often choose the lowest quote, assuming they’llreceive exactly the same 
  • Unfortunately, lower fees usually mean fewer engineering hours.
  • Less time is available to optimise the design, challenge assumptions or explore more efficient solutions.
  • Sometimes the Chartered Engineer wins the project, but much of the detailed design is completed by less experienced staff.

There’s nothing wrong with graduates undertaking design work, they are the future of our profession, but robust checking by experienced engineers is essential. 

Without it, opportunities for optimisation can easily be missed. 

How can clients protect themselves? 

Choosing an engineer shouldn’t simply be about the lowest fee. 

Ask questions. 

  • Who will actually carryout the design? 
  • Who checks the calculations?
  • How is the design optimised?
  • What is the engineer’s approach to material efficiency?

It is also worth ensuring your appointment includes a clear requirement for an efficient and economical design, not simply one that satisfies the minimum structural requirements. 

That expectation benefits everyone. 

Engineering is about solving problems, not creating unnecessary cost 

As Expert Witnesses, our role isn’t to criticise fellow professionals. 

It’s to provide an independent technical opinion based on engineering principles, experience and current design standards. 

The best structural engineering is often invisible. 

It uses exactly the right amount of material. 

No less. 

No more. 

Because good engineering isn’t measured by how much steel or concrete you specify. 

It’s measured by how intelligently you use it. 

Following recent decisions by some Building Control authorities to introduce a blanket ban on approving screw pile foundations, it’s a timely moment to pause and examine what’s really going on.

In a recent discussion with John Staves, Chartered Structural Engineer and the UK’s screw pile specialist, one thing became immediately clear:

Building Control concerns are justified, but the terminology is muddying the waters.

The Root of the Problem: Terminology Confusion

The phrase “screw pile” is being used too loosely.

In practice, it’s often incorrectly applied to two very different systems:

  • Ground screws (lightweight, shallow, friction-based systems)
  • Helical piles (engineered, deep, end-bearing systems)

This confusion is not just semantic it has real structural consequences.

What Is a Ground Screw?

Ground screws are typically:

  • Up to 2m in length
  • Installed from the surface (handheld or small machinery)
  • Variable in form, ranging from large threaded screws to twisted square bars


How Ground Screws Work

Ground screws rely primarily on:

  • Shaft friction
  • Resistance from the surrounding shallow soil

This means their performance is entirely dependent on the condition of the soil along their full length.

The Critical Weakness

Ground screws are often used in unsuitable conditions, especially:

  • High shrinkability clay
  • Areas within the zone of influence of trees
  • Sites requiring deeper, stable bearing strata

If the top 50–100cm of soil dries and shrinks (common in clay), you lose capacity immediately.

A recent example:

We were approached by a homeowner who had installed a garden room using ground screws (1.2m deep) in high shrinkable clay, located 5m from an oak tree, and he was experiencing seasonal movement.

As moisture levels changed, the clay expanded and contracted, causing the structure to rise and fall, just like a shallow foundation.

It was suggested an attempted fix would be to excavate around the ground screws and backfill with concrete – this would only make matters worse, creating an irrecoverable and poorly performing shallow pad foundation.

A more appropriate fix would have been helical piles to 4m depth.


What Is a Helical Pile (True “Screw Pile”)?

Helical piles are a completely different technology.

They consist of:

  • A central steel shaft
  • Discrete helical plates (helices) welded at intervals
  • Modular extensions to achieve depth


How Helical Piles (Screw Piles) Work

  • End-bearing system
  • Load is transferred through the helices into deeper, more stable strata
  • Not reliant on shallow soil conditions

Unlike ground screws, they are engineered foundation solutions.


Why Helical Piles Perform Differently

  1. Load Transfer Mechanism
  • Helical piles: End-bearing through helices
  • Ground screws: Shaft friction in upper soils

This is the fundamental difference.

  1. Depth and Stability

Helical piles are installed in sections, allowing them to:

  • Reach deeper competent strata
  • Avoid influence zones (e.g. tree roots, shrink/swell zones)

Ground screws cannot achieve this in any meaningful way.


  1. Torque = Capacity (A Critical Advantage)

One of the most powerful features of helical piles is:

Installation torque directly correlates with load capacity

  • Higher torque = stronger ground = higher capacity
  • Measured in real time during installation using calibrated equipment

This gives Building Control something rare: on-site validation of performance as the foundations are installed. No waiting for concrete to cure. No waiting for testing.

  1. Engineered Design vs “Off-the-Shelf”

  • Ground screws:
    • Typically selected from catalogues
    • Rarely designed for site-specific soil conditions
  • Helical piles:
    • Designed using:
      • Site investigation data
      • BGS records
      • Trial installations (torque testing)

Installation and Design Detail (What Good Looks Like)

Helical pile helices are:

  • Circular steel plates
  • Cut and formed into a spiral
  • Welded at specific angles and spacing

Spacing is critical:

  • Typically 3x the diameter of the helix
  • Ensures efficient load transfer and avoids interaction between plates

These aren’t lightweight components they are:

  • Thick-walled steel shafts
  • Designed to withstand high installation torque (often the maximum stress they will ever experience)

Why Building Control Is Right to Be Concerned

The issue is not that “screw piles don’t work.”

It’s that:

Ground screws are being used where engineered deep foundations are required.

They may perform adequately in the short term, but:

  • They remain vulnerable to shallow ground movement
  • They behave like shallow foundations
  • They do not address geotechnical risks

Where Ground Screws Do Work

To be fair, ground screws have a place:

  • Lightweight structures
  • Stable, granular soils
  • Situations without shrink/swell risk

But they are not a universal foundation solution.

How Building Control Can Move Forward

Rather than a blanket ban, a more robust approach could be:

  1. Demand Engineered Solutions

    • Require site-specific design
    • Distinguish clearly between ground screws and helical piles
  1. Require Torque Verification

    • Calibrated torque heads
    • Digital readouts
    • Data logging of installation
  1. Encourage Validation Testing

    • Trial installations to confirm design assumptions
    • Adjust depth based on achieved torque

The Case for Helical Piles

When properly designed and installed, helical piles offer:

  • No spoil removal
  • Immediate load-bearing capacity
  • Suitability near tree roots (displacement installation)
  • Adaptability to variable ground conditions
  • Real-time verification of capacity

Conclusion

The current concern from Building Control authorities is both understandable and justified.

What’s being challenged is not the principle of screw pile foundations but the misuse and misunderstanding of two very different systems.

Ground screws and helical piles are not interchangeable. One relies on shallow soil conditions and is highly susceptible to environmental changes; the other is an engineered, verifiable deep foundation solution designed to perform reliably across a range of ground conditions.

For Building Control officers, the key lies in clarity and specification ensuring that what is being proposed is appropriate for the ground conditions, properly designed, and capable of being verified on installation.

Many structural failures don’t begin with visible signs. They start hidden, silently corroding, shifting, or degrading out of sight.

Take reinforced concrete for example.

Steel reinforcement can rust inside perfectly smooth concrete.

Once corrosion begins, it expands and cracks the surrounding material from within. By the time you see a hairline crack? Damage is already done.

Or consider buildings with RAAC panels. To the untrained eye, they often look like any other ceiling slab. But hidden deterioration in these materials has caused sudden collapses, even in seemingly “healthy” buildings.

And it’s not just the dramatic failures.

Minor structural issues can gradually compromise safety, reduce asset value, and trigger costly emergency repairs.


Routine Structural Maintenance Inspections

Routine structural maintenance inspections are like regular health check-ups for your building.

Done proactively, they;

  • Catch hidden issues early before they become expensive problems
  • Protect tenants and users by ensuring structural safety
  • Extend the building’s usable life and performance
  • Provide reassurance for insurers, stakeholders, and auditors

Just because there’s no obvious damage doesn’t mean all is well.

Book regular inspections with a Chartered Structural Engineer who understands not just buildings but the subtle clues that precede failure.

Think of it as preventative medicine for your most valuable asset.

In the world of structures, peace of mind doesn’t come from what’s visible, it comes from a thorough assessment by a trained eye that can spot the subtle, hidden clues others miss.

A recent report by CROSS- UK (Collaborative Reporting for Safer Structures) identified a potential disaster due to inadequate structural design.

A Chartered Structural Engineer, was called upon to review the design for the removal of a loadbearing wall during a refurbishment and uncovered critical flaws that could have had dire consequences.


The Design

“The design showed four steel beams, steel columns, some lintels, and new foundations.

It did not show how applied loads had been calculated and did not allow for any wind loadings. No calculations had been provided to show how the beams should be framed with the columns to provide sway stability.

The structural information showed new foundations, but trial pits dug by the builder revealed competent existing foundations which could be reused.

The builder and building control body had agreed that two of the proposed new structural members could be omitted since there was no loading applied to them, and they were not required for reasons of stability”.

The design did not show how applied loads had been calculated and did not allow for any wind loadings – this was luckily picked up by a competent builder.


As minimum you should expect your structural engineer to;

Lateral Stability

Unfortunately, some homeowners mistakenly assume that the walls they intend to remove serve solely to support vertical loads. However, these walls may actually play a crucial role in providing lateral stability for the entire building.

Buildings may collapse if walls are removed without measures to safeguard the overall stability of the building. Clients should understand that structural engineering, domestic work included, is a complex discipline that should only be entrusted to a suitably qualified and experienced person such as a professional civil or structural engineer.

In Conclusion

Efforts to communicate with the structural designer failed to resolve the issue, ultimately leading to a halt in construction.

Subsequent review revealed that the original designer had not visited the site, casting doubt on their competence and qualifications.

This incident underscores a widespread problem in the industry: individuals claiming to be structural designers without the requisite expertise.

These unqualified practitioners pose serious risks to public safety, as evidenced by reports from organisations like CROSS (Confidential Reporting on Structural Safety). The repercussions of inadequate design can be dire, potentially endangering lives and resulting in legal consequences.

Today I’m talking to John Staves, Chartered Structural Engineer about the increasing number of insurance claims for subsidence. 2023 saw a dramatic rise in the cases of subsidence as the UK experienced recording breaking dry weather.

John, What Has Been Your Experience of Subsidence?

Since mid 2023 enquiries in our office relating to “cracks in walls”  have doubled. Understandably homeowners are worried that their house is falling down. 

How Can People Tell The Difference Between Subsidence and General Wear and Tear?

New houses usually settle during the first few months and even years after construction, so minor wall cracks are likely.These are usually due to thermal movement and often occur at changes in construction such as between a wall and a ceiling and around door frames.However, gaping cracks, separation and horizontal crack lines might be signs that the issues are more severe.

  • They are usually diagonal, and wider at the top than the bottom;
  • They tend to be thicker than a 10p coin;
  • They are often found around doors and windows;
  • Subsidence may also cause dry wallpaper to rip or crinkle and;
  • Doors and windows may start to stick

What Is Subsidence?

Subsidence is defined as;“the gradual caving in or sinking of an area of land.”

What Are The Causes of Subsidence?

Generally, there are two types of Subsidence;

One-off type Movements – often caused by leaking drains. Worse where the ground is granular, as a leaking drain washes out the fines in a granular soil. If you repair the drain, then make good the cracking in the house, there should be be no further movement.

Seasonal Movement – often caused by the ground drying out (made worse in clay soils and/or you are near to certain types of trees).Once movement has been monitored, you are best to underpin the property so that the foundations are founded on soils that are no longer subject to seasonal change.

Should I Buy A House That Has Had Subsidence?

Insurers and mortgage lenders are nervous about properties that have either had subsidence or are near to properties that have had subsidence – it seems to blight a property.If the property has had subsidence and it has been repaired eg underpinned, it’s on very good foundations now and isn’t likely to move again.However, the re-sale value will likely be low and it might be expensive obtaining house insurance in the future.

Can You Sell Your House If It’s Had Subsidence?

Yes you can, however it’s likely that the value will be slightly reduced and it might put off potential buyers who are risk-averse.

I think My House Has Subsidence – Can It Be Reversed? What Actions Can I Take?

It depends on the extent of the cracking and what caused the cracking in the first place.You would need to find out if the building still moving – ideally appoint a Structural Engineer who would carry out a detailed investigation.

Trial Holes

To identify the depth of your existing house foundations, trail holes would need to be dug adjacent to your house (your Structural Engineer should be able to arrange this for you).This would confirm the depth of your existing foundations and also what type of soil they are founded on.In the Thames Valley, the main cause of subsidence is clay soils.Soil samples may be taken and tested.


How Do You Monitor The Cracking?

Your Structural Engineer will need to establish whether the crack is increasing in size. The best method for measuring crack movements is by use of a crack monitor or ‘tell-tale‘. 

Once the “tell-tale” is fixed in position an initial reading is taken. Then more readings are taken at regular intervals to establish if movement is occurring and if so, at what rate. By comparing the different rates of movement for cracks at different locations in a building, the cause and location of the weakness can be established.

The monitors should be left in place for as long as possible to establish whether the crack is moving or not and for a minimum of eight weeks.



Subsidence Cracking

The shape of the crack can tell us which part of the building is moving, in which direction, relative to the other parts of the building.

Cracks can be vertical – a vertical shear. This normally occurs if your foundations are founded on different types of soil and your house will “sink” on the side with the lowest bearing pressure.Usually, you get “rotational movement” – often cracking is wider at the top than the bottom.Or sometimes a corner of a house might have lifted, or the middle of a wall panel might have sagged.


What Is Underpinning?

Underpinning is a method used to increase foundation depth or repairing faulty foundations.If monitoring has established that movement has not stopped, your property can be underpinned.

The aim is to take your existing foundations down to a lower depth where they won’t be affected by seasonal movement and moisture change.This is normally carried out with mass concrete foundations (although there are other methods), designed by a Chartered Structural Engineer.

How Do I Repair Cracks in My Wall?

Cracks can be repaired by raking out the joins and re-pointing. If the cracks have gone through bricks, you’d normally replace the brick.In some cases, you might do something called crack stitching” where you add reinforcing bars to the horizontal joints in the masonry to strengthening them ..stitch it all back together!

Will Subsidence Devalue My Home?

Yes, but mainly through ignorance and public perception. Once it has been mended it will be stronger than when it started out.

How Does Subsidence Affect Insurance?

Unfortunately, insurers take a very risk-averse approach and if there has been subsidence either at the property or even in the neighbouring properties in the same post code, you could find that the premiums are higher.

How Can Subsidence Be Prevented?

Making sure that your drains are well maintained so that they don’t have a chance of causing wash out if you are in granular soils.

By ensuring that your foundations aren’t within soils which change volume seasonally with moisture content (good design at the outset).Keep trees pruned and controlled at a steady height. Don’t drastically take the trees down as this will may lead to “heave”.By keeping the trees at a steady height the water demand will remain similar and all things being equal, it should be OK.The problem occurs when we have a very dry summer.

You get desiccation through natural evaporation through the surface, so you don’t have to have a tree nearby to get subsidence if your house is built on a clay soil because it will still dry out.Trees to avoid / ensure that they are planted a safe distance from your property; Willow, Poplar, Oak and Ash.

How Can a Structural Engineer help With Subsidence?

A Structural Engineer will determine what is actually happening by intrusive investigation, for example, trial holes to find out what the foundations are actually sat on.If we know we are on sandy soils and there is a drain nearby, it could be that there is a leak in that drain.

Normally this occurs on the bend in the pipe.If it goes unnoticed or ignored, it can cause wash out under the foundations.Sometimes it can also happen with heavy rainfall. If you get excessive water movement in the founding levels you get movement; if the water table rises you’ll get subsidence because the load bearing capacity of the ground reduces if its on a granular soil.

One of the problems in London is the rising water table because we don’t extract from the aqufa in the same way that we used to.A Structural Engineer is specialist and understand how a structure works and subsidence is clearly a structural issue.In this area of the UK, clay soil is the main cause of subsidence.

1. The Party Wall Act 1986

What Does It Mean?

Put simply, if you are carrying out building work to your party wall or boundary and you damage it, you have a legal duty to repair it. In other words to act as a “good neighbour”.

It is a legal duty for a Building Owner to serve the appropriate notices in the correct manner. Failure to do so can result in an injunction being sought to stop the works.

For example, the Party Wall Act will apply if you carry out work to;

  • Building a new party wall on the boundary or a wall adjacent to the building owner’s side of the boundary.
  • Carrying out works to an existing party fence wall or party structure, including rebuilding a wall to a reduced height.
  • Building within three or six metres of the adjoining owner’s walls or buildings if the works involve excavation works.
  • Building or placing special foundations on the adjoining owner’s land.

Notice Requirements Under The PWA 1996

A building owner must give notice to all adjoining owners of any planned works. The notice requirements will depend on the type of works that are to be undertaken.

There are 3 types of notices;

  1. Line of Junction
  2. Party Structure and
  3. Notice of Adjacent Excavation

In many situations, more than one type of notice is required and it is essential that you ensure all notices required under the Act are given.

When Should A Party Wall Notice Be Served?

Party Wall Notices should be served at the earliest opportunity in order to ensure that there is sufficient time for the notice to run and for negotiations, if a dispute arises, to be undertaken. However, notices are only valid for 12 months so caution should be given so as not to serve the notice too early either as they may then expire before works commence. This is not usually an issue with smaller domestic scenarios but should be factored into larger, longer-term projects.

Party Structure Notices are required to be served two calendar months prior to the commencement of works

Line of Junction and Notice of Adjacent Excavation one calendar month prior to the commencement of works.

2. Planning Approval and Building Regulations Approval

With all building work, the owner of the property (or land) in question is ultimately responsible for complying with the relevant Planning rules and Building Regulations (regardless of the need to apply for planning permission and/or building regulations approval or not).

If you don’t follow these rules, as the homeowner you will be liable for any remedial action (which could go as far as demolition and/or restoration).

You will need to check that whoever you appoint to draw up your plans has suitable experience when dealing with the Local Authority – this will help smooth your path through the planning and building regulation process.


Planning Approval

You should receive a decision within 8 weeks of registering your application.

You need to make sure that you have included all of the relevant information and the correct fee, otherwise the clock doesn’t start ticking until the application is officially “registered”.


Factors Affecting Planning Permission

There are many factors that will affect whether or not you need to apply for planning permission or affect your chances of gaining planning approval.

Some properties have “permitted development rights”.

This means that you can improve and extend your home without the need to seek specific planning permission as long as you comply with a special set of rules.

Some properties do not have these rights or may have had them removed. You will need to check with the Local Authority, who should be able to confirm this for you.

Permitted Development Rights

If your property has permitted development rights, there has been a temporary increase to the size limits for single-storey rear extensions, provided the construction work is completed by 30th May 2019. Even if your building works do not require planning permission it would strongly advise you to apply for a “Lawful Development Certificate”.

Lawful Development Certificate (LDC)

This is an application that you make to the Local Planning Authority – they will review your proposed building works – provided that it falls within permitted development parameters, they will issue you with a “Lawful Development Certificate”.


If you ever come to sell your property you will need this certificate to prove that any works carried out on your property are “lawful”.

This normally takes between 6-8 weeks for a decision.

Building Regulations Approval

What Are Building Regulations?

The Building Regulations are minimum standards for design, construction and alterations to virtually every building. They are developed by the Government and approved by Parliament.

Building regulations set minimum standards for the design and construction of buildings to ensure the safety and health for people in or about those buildings.

They also include requirements to ensure that fuel and power is conserved and facilities are provided for people, including those with disabilities, to access and move around inside buildings

What Do I Need To Do To Get Building Regulations Approval?

There are two methods of applying for Building Regulations approval;  either a

  • Full Plans application, or
  • Building Notice application

A “Full Plans” Application. It is a two-step process; approval of detailed drawings (Plans approval) and approval of on-site inspections (Inspections approval)

What Do You Need To Submit To Building Control?

Typically, you will need to submit detailed plans and elevation drawings and a detailed specification as to how the building will be constructed.

If you are carrying out structural work, then you will need to appoint a Structural Engineer who will produce the necessary details for the builder to build to and also the Structural Calculations to prove that the building will be structurally sound.

How Long Before I Get A Decision From Building Control?

The application is submitted for checking and a formal decision notice is given (normally within 8 weeks).

Advantages of using this method are;

  • the plans can be examined and approved before work starts and the builder can work to the approved drawings in the knowledge that the detail complies with the regulations.
  • Approved plans may be used for up to three years after they have been approved, even if the regulations change.

A Building Notice Application is a less detailed form of application where minimal information is initially required and no formal decision is given.

You are relying on the builder to build without “approved plans”, generally Building Control do not like this type of application, as you are relying heavily on the competency of the builder on site.

If Building Control do not accept something the builder has done, you will be responsible for remedying it (making good). This often leads to an argument between the home owner and builder because neither party wants the additional costs.

Also, this form of application typically costs you more than a full plans submission as you have to pay all the costs upfront, rather than in two stages when you submit a  Full Plans application.

If you have carried out building works to your property without obtaining Building Regulations approval you will need to apply for a Regularisation Certificate.

What Is A Regularisation Application?

“A regularisation application is a retrospective application relating to previously unauthorised works i.e. works carried out without Building Regulations consent, started on or after the 11 November 1985. The purpose of the process is to regularise the unauthorised works and obtain a certificate of regularisation”

As you have carried out work without prior approval the Local Authority may request that you “open up” the works so that they can ascertain if the building works comply with current standards.

As this is classed as an “enforcement application” it does not attract VAT, but the cost is greater than the other forms of application.

Pre-Application Inspections

Some Local Authorities offer a “pre-application” inspection service. This is where they will come out to site to look at your building to check it complies before you make a formal application.

Examples of this might be where you are proposing a two-storey extension, but need advice as to whether or not the existing foundations are able to take the extra load.

They would ask you to dig a “trial” pit next to the existing foundations, then Building Control would come out to inspect it. Often they would seek confirmation from your design Structural Engineer as well.

They charge a fee for this service, so best to check with your Local Authority.


3. Construction (Design and Management) Regulations 2015 (CDM 2015)

What Are These Regulations?

The aim of the CDM regulations is to improve the Health, safety and welfare of workers in the construction industry.

Do These Regulations Apply To Homeowners As Well?

Yes. The regulations changed in April 2015 and now place a legal obligation on the homeowner (Client).

The homeowner is not expected to be an expert in construction, so you have the option to transfer your duties to the Contractor or Principal Contractor (If more than one contractor is working on the project).

Alternatively, the homeowner may choose to have a written agreement with a Principal Designer to carry out the duties.

What Are These New Regulations For?

They help ensure that no-one is harmed during the construction work, and that your building is safe to use and maintain while giving you good value. Effective planning will also help ensure that your work is well managed with fewer unexpected costs and problems.

4. Building Over Agreement – Drainage

A Building Over Agreement is an approval from your local water company for the building work that you plan to have carried out over, or near a public sewer owned by the local Water company.

What Is A Public Sewer?

A sewer is a pipe that serves more than one property. All drainage pipes (that connect to your local Water Authority) are now public sewers except where only one property is served by the existing pipe, which is known as a drain.

A drain is privately owned and maintained to the property boundary by the home owner, once it crosses the property boundary this pipe becomes the responsibility of the Water company.

Why Do I Need A Building Over Agreement?

If you are building over a public sewer, or one that runs within 3 metres of the proposed building works you have to make sure that the new foundations are far enough away from the drain and that sufficient access to the sewer is maintained so that they can clean or repair it if necessary.

You will need to make sure that;

The extra weight of the proposed building work near to, or above the sewer will not cause it to collapse, resulting in structural damage to the new building.  Access must be maintained for the local water company to carry out maintenance and repairs.

Do I Always Need to Apply for A “Building Over A Sewer” Agreement?

You will not need a Building Over Agreement if you are able to move the building works so that they are more than 3 metres away from the sewer.

You may be required to divert the sewer. This work would be carried out by your local water authority, but at your cost.

How Do I Find Out If I Am Building Near A Public Sewer?

You will need to contact your local water authority and make an application either on line or by post.

How Much Does A Building Over Agreement Cost?

The cost depends on the size of the pipe. It can vary from £350 – £1,300.

What Do The Fees Cover?

  • Processing the application
  • Technical reviews of plans
  • Discussing and agreeing any changes in design
  • Liaising with the local authority in line with building regulations
  • Issuing consent
  • Registering the build over on records CCTV (Class II and BO Class III)
  • Site visit to locate sewers if needed

What Is The Process Of Building Over A Sewer?

Make an application to the relevant water authority, enclosing the relevant site plans, sections and elevations of the proposed works. Include the correct fee.

You may need a CCTV survey before you begin work to see whether or not the pipe requires any repair work before the building work commences.

They might also carry out the CCTV survey after the building works to check to make sure that no damage has been done to the sewer.

How Long Does It Take To Receive Approval For Building Over A Sewer?

Approximately three weeks – you shouldn’t start any work on site until you have received approval.

6. House Insurance

Home Insurance

A common misconception is that your home insurance will cover you while you undertake your project.

Beware: most home insurance providers will not cover your building if you are changing the structure of the build — for example if you are extending, converting or renovating.

With some insurers, a renovation or extension on your home may reduce the protection of your current home insurance policy or invalidate it completely, leaving your biggest asset potentially uninsured.

Most insurers will ask you to notify them of the works and may either withdraw or limit the cover provided.

Builders Insurance

Your Builder will probably have “Public Liability Insurance” however, this will not cover issues like;

· storm damage

· theft of materials, plant and equipment

· arson or

· foreseen liability

You Are Buying Materials

If you are sourcing and buying some of the materials yourself, your builders public liability insurance will not cover this and you will need to insure them yourself.

Neighbours Foundations

Public Liability insurance will also not cover you if your builder is working near your neighbour’s foundations and damages or weakens them.

Managing the Build Yourself

If you are managing or exercising control over the project yourself you automatically carry the responsibility for health & safety eg if a builder slips off a scaffold or ladder, you will carry the responsibility and could end up being prosecuted and fined.

Vacating Your Property

If you are vacating your property during the build, you will require site insurance or unoccupied buildings insurance which will usually be a minimum six month policy. Always contact your existing insurance provider to notify them of works before you start.

In summary;

· check what insurance your builder is carrying

· speak to your current house insurance as soon as possible to notify them of work to your property and they will be able to advise you.

John, can you tell me about your role as an expert witness structural engineer, what type of disputes do you get asked to help with?

In my role as an expert witness, I am appointed to provide an impartial opinion on technical cases within my area of expertise – normally disputes arising from defective structural design or construction

Can you describe a recent case?

A recent case was a leasehold first tier tribunal (property division).We were appointed by the freeholder of a property who had proposed structural works to an estate, the leaseholders on the estate challenged the need for the works and the cost of the works.

How did you help?

The initial witness statement was a joint statement from the whole of the professional team on the freeholder’s side; myself, the barrister and the managing agent.As the Leaseholders’ technical advisors were not in attendance, and as a Chartered Structural Engineer and Fellow of the Institution of Structural Engineers the freeholder’s barrister requested that I be moved up to “Expert”.This meant I could give my professional opinion as well as confirm facts.

What is the role of the tribunal?

The Tribunal reviews the situation and makes sure that the freeholder is behaving sensibly and fairly.

Did you have to go to court?

Normally I would attend court, however due to COVID the case was heard online.I was in the witness box for 2 hours and was cross examined by the first applicant and the barrister acting for a group of leaseholders who were party to the application.

Who makes the decision?

The three panel members, including a judge, will determine the application.

How long before a decision is made?

The verdict is usually within 6 weeks.

What is a Certificate of Structural Adequacy?

A Certificate of Structural Adequacy is issued if you have had work completed on your property, typically where you have had subsidence, heave, or landslip. It can also be issued by an independent Chartered Structural Engineer to provide reassurance to the building owner that what has been built, is what was designed.

In the case of subsidence, the certificate of structural adequacy details the causes of the damage, the repair work undertaken and confirms that the work was carried out correctly and that the property is now structurally sound.

Who Usually Issues a Certificate of Structural Adequacy?

Loss adjusters, mortgage providers and insurers normally require the certificate to be issued by a Chartered Member of the Institution of Structural Engineers.

When is a Certificate of Structural Adequacy Issued?

Following completion of any building work and/or structural repairs and (in the case of underpinning) after a period of monitoring.


Is Building Regulations Approval Required for Structural Repairs eg underpinning aswell?

Yes. If you are carrying out underpinning work, under the Building Regulations it is deemed to be “building work” and would require Building Regulation approval.

Can I Get A Retrospective Certificate of Structural Adequacy?

Yes, but you would need to expose all of the structural elements of the build so that the engineer would be able to see that what has been built is correct (eg. as per the engineers’ design drawings), so the best thing is to have the engineer inspect during the works

Why Do I need a Certificate of Structural Adequacy if I have obtained Building Regulations Approval – Building Control Inspect Don’t They?

Building control only inspect a limited number of parts of the build.

The Chartered structural engineer would inspect at regular intervals to check to make sure that his/her design was implemented correctly. The Certificate of Structural Adequacy closes the loop. It makes sure that the builder has built what he has been paid to build.

Does A Certificate of Structural Adequacy Guarantee the Work?

In effect, the structural work will be guaranteed by the chartered engineers’ professional liability insurance. This insurance covers the design and advice provided and with satisfactory inspections it is clear where responsibility lies.  If the builder hasn’t correctly implemented the design, this devalues the benefit of the insurance.

How much does a Certificate of Structural Adequacy Cost?

They can vary from £195+VAT to £295+VAT .

How Much Does Is Cost To Have a Chartered Structural Engineer Oversee The Build?

Again, this can vary, depending on the complexity of the job and hence the number of visits required to ensure the design is correctly implemented.

A Recent Example

This was a small project in Reading, Berkshire but demonstrates what can go wrong when you trust the builder to follow the approved plans, without any independent checks

  • The client obtained Building regulations approval for their project.
  • The builder built what he thought was correct (didn’t follow the drawings).
  • The client was none the wiser, as they didn’t know how to read the drawings.
  • The builder didn’t call out building control to inspect the works (even though there was a building control application and inspections should have been made).
  • Only after the works were completed did the client realise – he hadn’t received anything from building control.
  • Building control confirmed that they hadn’t inspected at all.
  • The client had photographs of the works being carried out, unfortunately, it was clear that the builder had not built to the approved drawings.

How Did the Client Resolve The Matter?

Sadly, this is not yet resolved.

The builder left site with the clients money and the client is left with a bill to sort out, or live with a structural defect and a potentially devalued property (as conveyancing solicitors would typically warn their clients not to buy a property without the final completion certificate).
